Terms of Use for PSS®X

  1. Acceptance of Terms

    By downloading, installing, copying, or otherwise using the software library "PSS®X" (the "Library"), you ("User" or "You") agree to be bound by these Terms of Use. If you do not agree to all these terms, you are not permitted to use the Library.

  2. License Grant

    The Library is free software licensed under the GNU Lesser General Public License version 2.1 (or, at your option, any later version) ("LGPL"). The full text of the LGPL is included with the Library's source code distribution and can be found at https://www.gnu.org/licenses/old-licenses/lgpl-2.1.html (for v2.1) and https://www.gnu.org/licenses/lgpl-3.0.html (for v3.0).

    This license grants you the freedom to: - Use the Library for any purpose, commercial or non-commercial. - Copy and distribute the Library. - Modify the Library's source code.

    Distribute your modified versions of the Library, provided you adhere to the terms of the LGPL.

    Crucially, the LGPL allows you to use this Library in your own proprietary (closed-source) software, provided you comply with the linking and attribution requirements of the license.

  3. Key LGPL Obligations (Your Responsibilities)

    If you distribute software that uses this Library (whether modified or not), you must comply with the LGPL. Key obligations include:

    Attribution: You must give prominent notice that your software uses the Library, include a copy of the LGPL license, and acknowledge the copyright of the original authors.

    Source Code Availability: If you modify the Library itself, you must make the modified source code available under the same LGPL terms. This does not require you to open-source your entire application.

    Linking Rights: You must allow users to reverse-engineer your application to debug or modify the Library, and you must provide a way for them to replace the LGPL-licensed Library with a modified version (e.g., by using dynamic linking or providing object files for relinking).

    You are solely responsible for understanding and complying with the full terms of the LGPL license for your use case.

  4. Disclaimer of Warranty

    THE LIBRARY IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE LIBRARY IS WITH YOU.

    This is a standard and required part of the LGPL and free software licenses.

  5. Limitation of Liability

    IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING WILL THE COPYRIGHT HOLDER, GridLab, OR ANY OTHER PARTY WHO MODIFIES AND/OR DISTRIBUTES THE LIBRARY AS PERMITTED ABOVE, BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE LIBRARY (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF THE LIBRARY TO OPERATE WITH ANY OTHER SOFTWARE), EVEN IF SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  6. Intellectual Property

    The copyright and all intellectual property rights in the Library are owned by GridLab and its contributors. The LGPL license grants you specific rights to use this intellectual property; it does not transfer ownership.

  7. Contributions

    If you submit contributions (e.g., patches, bug fixes, enhancements) to the Library, you hereby grant GridLab a perpetual, worldwide, non-exclusive, royalty-free, irrevocable license to use, reproduce, modify, and distribute your contributions under the LGPL license. You represent that you have the right to grant this license for your contributions.

  8. Governing Law

    These Terms of Use shall be governed by and construed in accordance with the laws of Nuremberg/Germany, without regard to its conflict of law provisions.
